END USER LICENSE AGREEMENT

("Licensor"), for use only under the terms of this License Agreement.

By downloading the Licensed Application from Apple’s App Store and any updates thereto, You agree to be bound by all terms and conditions of this License Agreement. The App Store is referred to in this License Agreement as the “Services.”

The parties acknowledge that the Services are not a party to this License Agreement and are not responsible for warranty, liability, maintenance, or support of the Licensed Application. Someone Somewhere is solely responsible for the Licensed Application and its content.

This License Agreement shall not conflict with Apple Media Services Terms.

The Licensed Application is licensed, not sold, and may only be used under the terms of this Agreement. All rights not expressly granted are reserved.

The application is intended for use on Apple operating systems (iOS and macOS).

1. THE APPLICATION

Someone Somewhere (the “Licensed Application”) is software designed to connect people around the world with lunches and virtual shared meals.

The Licensed Application is not intended to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. You may not use it in a way that violates such laws.

Solicitation of an indecent nature, including compensated acts online or offline, is strictly prohibited. Violations may result in a lifetime account ban.

2. SCOPE OF LICENSE

You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on devices you own or control, subject to Apple Usage Rules.

You may not:

Share or redistribute the application without written consent
Reverse engineer or attempt to derive source code
Modify, copy, or create derivative works
Remove intellectual property notices

Violations may result in prosecution or damages.

Licensor reserves the right to modify licensing terms.

3. TECHNICAL REQUIREMENTS

Requires firmware version 1.0.0 or higher
Latest firmware recommended
You are responsible for ensuring compatibility
Technical specifications may change at any time

4. MAINTENANCE AND SUPPORT

Licensor is solely responsible for maintenance and support.

Apple has no obligation to provide maintenance or support services.

5. USE OF DATA

Licensor may access and adjust downloaded content and personal information subject to the Privacy Policy.

Technical data may be collected to:

Provide support
Improve products
Facilitate updates

Data will be used in a non-personally identifiable form where possible.

6. USER-GENERATED CONTRIBUTIONS

The Licensed Application may allow users to post content (“Contributions”), including:

Text
Images
Video
Audio
Comments

You represent and warrant that your Contributions:

Do not infringe third-party rights
Are not misleading
Are not unlawful
Are not obscene, abusive, harassing, or discriminatory
Do not solicit prostitution or compensated acts
Do not violate privacy, publicity, or child protection laws

Violation may result in suspension or termination.

7. CONTRIBUTION LICENSE

By posting Contributions, you grant Someone Somewhere an unrestricted, irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, distribute, publish, display, translate, and create derivative works from your Contributions.

You retain ownership of your Contributions but grant full usage rights to the Licensor.

Licensor may edit, remove, or reclassify Contributions at its discretion.

8. LIABILITY

Licensor liability is limited to intent and gross negligence.

Liability for slight negligence applies only in breach of essential contractual duties.

Liability does not apply to injury to life, limb, or health.

You are responsible for maintaining backups of your data.

9. WARRANTY

Licensor warrants the application is free of malware at download and operates as described.

No warranty applies if the application:

Is modified without authorization
Is used improperly
Is combined with incompatible hardware or software

Defects must be reported within 90 days of discovery.

10. PRODUCT CLAIMS

Someone Somewhere, not Apple, is responsible for:

Product liability claims
Legal compliance claims
Consumer protection claims
Privacy-related claims

11. LEGAL COMPLIANCE

You represent that:

You are not located in a country under U.S. embargo
You are not listed on U.S. restricted party lists

13. TERMINATION

This license remains in effect until terminated.

It will automatically terminate if you violate its terms.

Upon termination, you must cease use and delete all copies.

14. THIRD-PARTY TERMS

Someone Somewhere will comply with applicable third-party agreements.

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it.

15. INTELLECTUAL PROPERTY RIGHTS

Someone Somewhere is solely responsible for addressing third-party intellectual property infringement claims related to the Licensed Application.

16. APPLICABLE LAW

This Agreement is governed by the laws of the State of New York.

17. PURCHASES AND AUTOMATICALLY RENEWING SUBSCRIPTIONS

Subscriptions automatically renew until canceled.

Canceling a subscription does not delete your account.

Pricing may vary based on region, promotion, and other factors.

Failure to cancel results in automatic renewal at the then-current rate.

17.1 External Service Purchases

Purchases made through Apple or Google Play must be managed through those services.

To cancel Apple subscriptions:

To cancel Google subscriptions:

Use Google Play settings
Contact Google Support

Chargebacks may result in account termination.

17.2 Internal Purchases

Internal purchases are processed through your provided payment method.

Subscriptions renew automatically until canceled in your account settings.

You authorize billing corrections and updated payment information retrieval.

17.3 Virtual Items

Virtual items:

Are non-refundable
Are licensed, not owned
Have no real-world monetary value
May be modified or removed at any time

ALL PURCHASES OF VIRTUAL ITEMS ARE FINAL.

17.4 Refunds

Generally, purchases are non-refundable except where required by law.

EU, EEA, UK, Switzerland:

14-day full refund right

Republic of Korea:

7-day full refund right

Certain U.S. states and Israel:

Cancellation rights within specified timeframes

Refunds for Apple purchases must be requested through Apple.
